WordClimber Privacy Statement

During your use of WordClimber (the Service) you perform actions that result in the collection and storage of information. This privacy statement discloses the information collected, how it is collected and how it is used.

The Service is owned and operated by Zimris, LLC (the Company)--a company incorporated in the United States of America, in the state of Arkansas. The Company is the sole owner of the information collected on this site. The Company will not share, sell, license or rent collected information to others in ways different from what is disclosed in this statement.

Information Collection, Storage, and Use

There are five main kinds of data we collect and use: personally identifiable data; aggregated demographic data; general, non-personally identifiable data; creative works; and electronic communication data.

Examples of activities that collect information include: creating an account, creating word logs, entering words, creating tags, uploading audio recordings, uploading pictures, completing word reviews, sharing word collections, taking surveys, and interacting with other users.

The information collected by the Service is stored on secured web servers, in databases, and on backup media. Our customer support team, developers, and server technicians will have access to the data collected by this site on a need to know basis in direct connection with their responsibilities administering the Service. In other words, when you request customer support the support team will need to access your account information.

Personally Identifiable Data

Personally identifiable data is information directly about you that can be used to identify you. Examples of personal data are name, email address, phone number, address, and billing information. We collect this data at the time of account registration, during interactions with customer support, and any time you add or edit your account details, subscription or billing preferences.

We use your personal data to administer and provide the Service. Examples of how we use your personally identifiable data to provide the Service include:

  • log you in to the Service
  • protect your account (confirm changes)
  • communicate with you about the Service or your Account
  • bill you for services purchased
  • provide customer support
  • troubleshoot or debug technical errors
  • identify accounts operating against our terms of service and site policies

We do not rent, license, or sell personally identifiable data. We do not share personally identifiable information outside of the Company and the vendors and contractors directly related to the provision of the Service.

Demographic Data

We aggregate, or combine, user information into non-personally identifiable demographic data to gain insight into overall trends and patterns related to our user base. Examples include: geographic regions, genders, and languages. The resulting demographic data is provided to managers, employees, contractors, investors, partners, and advertisers so they can make informed decisions. Demographic data is also shared with the media and general public to describe the audience and reach of the Service.

General, Non-personally Identifiable Data

General, non-personally identifiable data is data that does not describe a particular person. Examples of general, non-personally identifiable data collected by the Service include word logs, words, and tags. We collect this data when you add or edit word logs, words, and tags or when you complete reviews. Our main purpose for collecting the data is to provide you with the Service.

We may also aggregate and use this type of data in the provision of new features of the Service. It may be sold or licensed for research or use in related or unrelated products or services. For instance we may use meaning data to auto suggest a word meaning to a user while entering a new word; we may spin off a translation service based on word and meaning data; or a linguist may buy word data for analysis and research. While the Company reserves the right to pursue business interests with this kind of aggregated general, non-personally identifiable data, we do not sell, rent, or license your personally identifiable information.

Uploaded Pictures, Recordings and Creative Works

You may choose to upload and associate pictures, recordings, or other creative works with words in a word log on the Service. These creative works will be available to your account only. If the image, recording, or creative work is original to you, when you upload it, you grant the Company the right to use and store the image in provision of the Service. We do not rent, sell, license or share your pictures, recordings, or other creative works.

Electronic Communication Data

Electronic communication data is the data sent and received by electronic devices to facilitate the transmission of information. When a computer or mobile device connects to the Service it transmits information about the connection, the device and the software in use on the device through the Internet to our servers. Our servers log and process that data to handle the request. Examples of electronic communication data include: IP address, date and time of request, time zone offset, device brand and model, browser version, protocol, requested information, request headers, network identifiers, and referrer.

This data is logged, stored, and analyzed for the following types of uses:

  • operation of the Service and response to electronic requests
  • tuning the performance of web servers, networks, databases, APIs, apps and websites
  • troubleshooting Service errors
  • provision of account security
  • investigation of security breaches or criminal activity

We do not sell, license or rent electronic communication data. We do not share electronic communication data outside of our Company and the vendors and contractors directly related to the provision of the Service.

Cookies and Local Storage

A cookie is a piece of data stored in your browser or on your device containing information about a visit or actions being performed on the Service. We use cookies, local storage, and similar technologies for things like: keeping you logged in to the Service when you click “remember me”, storing temporary information such as word list sort order, storing offline data for syncing with the Service when you go back online and storing tokens to protect your visit from hijacking. We do not store personally identifiable data in Cookies. You may see or clear cookies and local storage used by the Service through your web browser.

Analytics and Metrics

We use analytics to measure, monitor, administer and understand usage of the Service. This type of data is collected with every interaction you have with the Service and relies on Electronic Communication Data, Cookies, and Web Beacons (tiny graphics with a unique identifier that work like a Cookie). The data in analyzed and reports are created to provide information to Service decision makers about things like popular content, traffic flow, traffic sources, demographic data, and traffic trends. We use both internal and third party services to facilitate the collection, analysis and compilation of analytics and metrics.

Interest Based and Behavioral Advertising

We use third-party advertising companies to serve ads on the Service as well as to display ads about the Service on third-party websites or apps. These companies may use aggregated information (not including your name, address, email address or telephone number) about your visits to this and other websites in order to provide advertisements about goods and services of interest to you. Community and Social Media Interactions

The Service includes community functionality and integrates with various third- party social media platforms. While we moderate and monitor these channels for abuse we do not directly control the flow and use of this information. Your use of community and social media functionality is optional. We recommend you exercise caution with the information you share and only disclose information you feel comfortable making public. This Privacy Statement does not cover what happens to information you share with a third-party social media platform. We encourage you to familiarize yourself the privacy practices of the social media platforms you use.

Surveys and Contests

From time-to-time the Service requests information from users via surveys or contests. Participation in these surveys or contests is voluntary and the user therefore has a choice whether or not to disclose this information. Information requested may include contact information, service usage practices, opinions, and demographic information. Contact information will be used to notify the winners and award prizes. Survey information will be used for purposes of monitoring or improving the use and satisfaction of the Service. If any information collected by the survey will be used in a way that is not directly related to the study or contest, we will explain the usage and provide a way along with the survey or contest entry form to opt in or opt out of your information being used in the additional manner.

The Service contains links to other sites and web services. Please be aware that we are not responsible for the privacy practices of such other sites or services. We encourage our users to be aware when they leave our site (or use an integrated service) and read the privacy statements of each website or service that collects personally identifiable information. This privacy statement applies solely to information collected by WordClimber.

Data Sharing with Service Providers and Contractors

To provide the Service we rely on contractors and service providers including developers, designers, web hosting companies, data storage companies, credit card processing companies, and email service companies. We share personally identifiable information, general information, communication data, and analytics data with these entities on a need to know basis in direct connection with the function they perform in the provision of the Service. We vet our contractors and vendors to ensure they are reputable and follow industry best practices in their privacy, security, and data retention policies.

Business Transfer, Sale, or Spin-off

In the event of a transfer, sale, spin-off or merger of the Service, a portion of the Service, or of the Company, information collected by the Service, including personal information, and the related rights to the information may be transferred to the acquiring Company or resulting business. At that time users will be notified with a prominent notice or an email about the transfer and be provided notice of the privacy practices of the new Service or Company.

Correcting and Updating Personal Information

If your personally identifiable information changes (such as your email address), you may correct and update it through your account controls. If you need help with these tools or need to update information stored by the Service for which there is no tool, please contact support.

Removal of Data

We provide tools to delete, hide or deactivate data shared with Service. If you need help with these tools or would like to request removal of information you have posted on the Service for which there is no tool, please contact support.

Information Security

Our commitment to you is that we will responsibly handle your data and take appropriate measures to protect it. We follow industry best practices to secure our servers, our offices, and workstations. We keep data under lock and key (both virtual and physical)—in most cases more than one. We restrict data access to only the employees or contractors who need it for the function of their job. We vet vendors and contractors to ensure they are reputable, trustworthy, and share our same commitment to data security. Please direct any questions about security of your data to customer support.

Unauthorized Use or Access of Data

While we do our best to secure your data, we also recognize big companies with strong security have had bad guys gain unauthorized access to data or misuse data. We take any data breach, data harvesting, or criminal misuse of data seriously. If at any point we discover data has been accessed or used in an unauthorized way we will work with law enforcement and take legal action in pursuit of justice. We will notify users impacted, launch an internal investigation, and take action to protect accounts and information. If you have reason to believe your account has been hacked or data is being misused please immediately contact support.

Legal and Law Enforcement Compliance

We may disclose information collected by the Service when required by law, when needed to comply with legal proceedings or when lawfully requested by federal or state law enforcement authorities.
